Terms of Service

These Terms govern your use of the FlatPing app and website ("FlatPing", "the Service"), operated by FlatPing InfoTech (OPC) Pvt. Ltd., a company being incorporated in New Delhi, India ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use FlatPing.

1. What FlatPing is

FlatPing is a real estate marketplace that connects people looking to rent or buy property directly with property owners, verified local brokers, and potential flatmates. We give you the choice of how you navigate real estate. FlatPing is a platform, not a party to any rental or sale agreement. We do not own, manage, inspect, or guarantee any property, and FlatPing itself does not act as a broker or agent. FlatPing operates only as an intermediary that hosts and transmits content provided by users, within the meaning of the Information Technology Act, 2000 and the rules made under it. We do not initiate the transmission, select the receiver, or modify the information contained in user listings and messages, except for lawful moderation as described in Section 10.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use FlatPing. By using the Service, you confirm that you meet these requirements and that the information you provide is accurate.

3. Your account

• You are responsible for keeping your login credentials secure and for all activity under your account.
• You agree to provide accurate information and to select the correct account intent (e.g., Renter, Owner, Broker) that reflects your actual use of the platform.
• You may not impersonate others, create accounts for anyone but yourself, or maintain multiple accounts to evade restrictions.
• Notify us promptly of any unauthorised use of your account.

4. Your listings and content

You are solely responsible for the listings, photos, messages, reviews, and other content you post. You represent that:

• You have the right to list the property and to post the content you provide.
• Your listings are genuine, accurate, and not misleading.
• Your content does not infringe anyone's rights or violate any law.

You grant FlatPing a non-exclusive, royalty-free licence to host, display, and distribute your content within the Service for the purpose of operating and promoting FlatPing.

Your listing is public. Once approved, a listing you post is shown both in the app and on a public page on flat-ping.com, so that a link you share can be opened by someone who does not have the app installed. These pages may be indexed by search engines. They show the listing details, photos and the first name and photo from your public profile — never your phone number, email address, or the property's exact coordinates. If you do not want a property visible on the open web, do not list it.

5. Acceptable use

You agree not to:

• Post false, fraudulent, duplicate, or misleading listings.
• Harass, threaten, spam, or defraud other users.
• Post unlawful, discriminatory, obscene, or harmful content.
• Collect or scrape other users' data, or use the Service to send unsolicited messages.
• Attempt to disrupt, reverse-engineer, or gain unauthorised access to the Service.
• Use FlatPing for any purpose other than genuine real estate transactions and flatmate connections.

5A. Tenant preferences on listings

When posting a property, an owner or broker may record preferences that apply to that property — for example food preference, smoking, drinking, pets, or preferred tenant type. These reflect the choices of the individual person listing the property. FlatPing displays them so that seekers are not put through wasted enquiries and visits, but FlatPing does not set, endorse, or verify them.

Preferences must never be used to unlawfully discriminate. Listings that exclude or disparage people on the basis of religion, caste, race, ethnicity, disability, sexual orientation, or any other characteristic protected under applicable law are prohibited and will be removed, and the account may be permanently banned. If you believe a listing crosses this line, please report it in the app.

7. Verification and reviews

Verification (including identity documents or RERA registration) is optional. Where completed, it indicates that we have reviewed the documents submitted. It is not a guarantee of any user's conduct or of any property. Users may leave reviews on Broker storefronts. Reviews must be honest and based on genuine transaction experiences; we may remove reviews that are fake, abusive, or violate these Terms. Brokers have the right to publicly respond to reviews on their profile.

8. Fees and advertising

FlatPing is free to use. We do not charge you usage fees or subscription fees, and we do not take any commission or cut of any property transaction. If you choose to engage a broker found on FlatPing, any brokerage fee is agreed and settled directly between you and that broker, independently of us.

FlatPing currently displays no advertisements. We may introduce advertising in the future (for example, through Google AdMob) or add optional paid or premium features. If and when we do, we will update these Terms and our Privacy Policy, update our Google Play data disclosures, and make the relevant terms clear before that feature goes live.

9. Dealings between users

Any rental agreement, sale contract, payment, deposit, visit, or other dealing arising from a connection made on FlatPing is solely between the users involved. FlatPing is not responsible for the conduct of any user, the condition or legality of any property, the truth of any listing, or the outcome of any transaction. We strongly encourage you to verify details independently, visit properties in person, use written agreements, and exercise extreme caution before transferring any funds.

10. Moderation and removal

We review listings and profiles and may edit, hide, or remove any content, and suspend or ban any account, that we reasonably believe violates these Terms or harms users or the platform. Where practical we aim to act fairly, but we may act without prior notice where necessary to protect users.

Listings are always reviewed before they go live. Profiles are reviewed as quickly as we can; if a review is not completed shortly after you sign up, we may grant you limited provisional access so you are not left waiting. Provisional access lets you browse, save properties and submit a listing for review, but you cannot message other users or view phone numbers until your profile is fully approved. Provisional access may be withdrawn at any time.

Repeat offenders. Where an account is removed for a serious violation, we may also record a one-way hashed identifier of the device used, so that we can detect an attempt to return on the same device. This is described in our Privacy Policy.

11. Intellectual property

The FlatPing name, logo, app, and design are owned by us and protected by law. These Terms do not grant you any right to use them except as needed to use the Service. Content you post remains yours, subject to the licence in Section 4.

12. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any listing, user, or property is genuine, accurate, or suitable.

13. Limitation of liability and indemnity

To the maximum extent permitted by law, FlatPing will not be liable for any indirect, incidental, special, or consequential damages, or for any loss arising from your dealings with other users, your reliance on any listing, any in-person meeting or property visit, or your use of (or inability to use) the Service. To the extent any liability cannot be excluded, our total aggregate liability to you for all claims relating to the Service is limited to the amount you have paid us for the Service, which for a free service is zero. Nothing in these Terms limits any liability that cannot be limited under applicable law.

You agree to indemnify and hold harmless FlatPing InfoTech (OPC) Pvt. Ltd., its directors, officers, and employees from and against any claims, damages, losses, liabilities, and costs (including reasonable legal fees) arising out of or connected with: (a) content you post; (b) your use or misuse of the Service; (c) your dealings or disputes with any other user; or (d) your breach of these Terms or of any applicable law or third-party right.

14. Termination

You may stop using FlatPing and delete your account at any time (see our Delete account page). We may suspend or terminate your access if you violate these Terms or where necessary to protect the Service or its users. Sections that by their nature should survive termination (such as content licences already granted, disclaimers, and limitations of liability) will continue to apply.

15. Governing law

These Terms are governed by the laws of India. Subject to applicable law, the courts of New Delhi, India will have exclusive jurisdiction over any dispute arising from these Terms or your use of the Service.

16. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you in the app. Continued use after an update means you accept the revised Terms.
